Do I need a lawyer to buy or sell property in British Columbia?

Yes. Unlike some provinces, BC requires a lawyer or notary to complete the legal side of any real estate transaction. That includes preparing transfer documents, registering the title change at the Land Title Office, and ensuring mortgage funds are handled correctly. While both lawyers and notaries can assist with many real estate transactions, a lawyer may be particularly helpful where a transaction involves complex legal issues, title concerns, corporate ownership structures, disputes, or other matters that extend beyond a routine

conveyance.

When is the right time to call a real estate lawyer?

As soon as your offer is accepted or earlier if you have questions about the contract before signing. Getting us involved early gives us time to review the Contract of Purchase and Sale, flag any concerns, communicate with your lender, and prepare closing documents without the pressure of a last-minute timeline.

What does a real estate lawyer actually do on closing day?

Behind the scenes, quite a bit. We receive mortgage funds from your lender, pay out any existing charges on title (for a refinance file), calculate adjustments with the other side, register the transfer and mortgage documents at the Land Title Office, and release funds to the appropriate parties. Most of this work takes place behind the scenes, which is why a successful closing is often uneventful from the client's perspective.

Can Truman Law help with private mortgage transactions?

Yes, this is a significant part of our practice. We regularly act in private mortgage transactions involving first and second mortgages, construction draws, equity-based lending, and secured loan arrangements. Whether you are a private lender looking to secure your investment or a property owner seeking alternative financing, we prepare and register the necessary documentation and ensure your interests are properly protected throughout the transaction. Note that in any given transaction, we act for one party only, either the lender or the borrower.

What if something goes wrong before closing?

It happens. Title issues, financing conditions that fall through, deficiencies discovered on final walkthrough, and contract disputes can all surface in the days before completion. We help you understand what your legal options are, whether that means negotiating a holdback, extending the completion date, or, in more serious cases, addressing a potential breach of contract. The earlier you flag a problem, the more options you have.

Can a lawyer help if my property is under foreclosure?

Yes, and time is critical. If you have received a demand letter, a notice of default, or court documents related to your mortgage, acting quickly gives you the most options. We assist property owners facing foreclosure or power of sale proceedings by reviewing your legal position, communicating with the lender or their counsel, and pursuing every available avenue whether that means negotiating a resolution, coordinating with your mortgage broker on alternative financing, or appearing in court to defend your rights. You will not face the process alone. The sooner you contact us, the more room there is to work with.

Can I refinance my mortgage if there is a lien or judgment registered against my property?

It depends on the circumstances. Builder’s liens, court judgments, and CRA arrears can all complicate or block a refinance if not addressed properly. We review title, advise on what needs to be paid out or discharged, coordinate with your lender, and manage the payout and discharge of registered charges as part of the refinance closing. In some cases, we can structure the transaction, so the existing lien is paid from the new mortgage proceeds at closing.

What if there is a builder’s lien on my property?

A registered builder’s lien can prevent you from completing a sale or refinance until it is resolved. We assist property owners, general contractors, and lenders in dealing with builders’ liens whether that means negotiating a discharge, posting security to clear title, providing notices to commence action or, if necessary, litigating the validity of the claim.

Can Truman Law help transfer property to a family member?

Yes. Family transfers are one of the most common transactions we handle. Whether you are adding a spouse or adult child to title, transferring a property as part of estate planning, restructuring ownership between family members, or dealing with a transfer following a separation or death, we prepare the necessary documents and register the change at the Land

Title Office. We also advise on property transfer tax exemptions that may apply to family transfers, so you are not paying tax you do not owe.

What if the property I am buying or refinancing has title issues?

Title issues range from minor administrative errors to more serious problems like undischarged mortgages from previous owners, encroachments, easements, or fraud. We conduct a thorough title review on every file and flag anything that could affect your ownership or your lender's security. Where title insurance is appropriate, we coordinate that as well. Our job is to make sure you know exactly what you are getting and that the title you

receive is clean and registerable.

How much are your legal fees?

Legal fees depend on the type and complexity of the transaction. We provide clear fee estimates at the outset and explain any anticipated disbursements, taxes, and third-party costs so there are no surprises at closing.

What types of business transactions does Truman Law handle?

Do you act for both buyers and sellers?

Yes. We act for purchasers, sellers, borrowers, lenders, investors, and businesses in residential and commercial real estate transactions throughout British Columbia. However, in any particular transaction, we can generally represent only one party to avoid conflicts of interest and to ensure our advice is focused solely on protecting our client's interests.

Do you handle wills, powers of attorney, and estate planning?

Yes. We prepare wills, enduring powers of attorney, and representation agreements for clients across BC. These documents are especially important for property owners, business owners, and anyone with dependents or complex assets. We can typically complete a basic estate planning package efficiently and in plain language you can actually understand.

Do you offer home visits or off site signing appointments?

Yes. Where a client is unable to attend our office due to age, illness, mobility limitations, or other circumstances, we can arrange to meet at a location convenient to them. This service is available for real estate closings, wills, enduring powers of attorney, , and other documents requiring execution. A travel fee applies in most cases. In exceptional circumstances, this fee may be waived at our discretion. Please contact us in advance to make arrangements.
